Terms and Conditions

These Terms and Conditions apply to all purchases form KickItDeals.com. 

1. Acceptance of your order:
We must receive payment of the price of the products, the gift-wrapping service (if applicable) and the delivery charges before we can accept your order. We reserve the right to restrict the number of products you may order and to refuse any order. If you have provided us with your email address you will receive an email from us confirming that we have received your order, or that your order is awaiting processing. We will notify acceptance of your order by sending an email to you stating that your order has been accepted and dispatched. Otherwise, our acceptance of your order takes place upon delivery of the products. Only when we have accepted your order is a binding contract created between us.

2. Prices:
Our prices are set out on our website in Australian Dollars and are inclusive GST where applicable. You are responsible for the disclosure and payment of any import duties or other taxes which apply in the country to which the products are delivered. Prices remain in force until we publish new prices on our website. Delivery charges may apply and are displayed during the order process.

There may be an option to view product prices in other currencies. Although the current exchange rate for these currencies is updated daily, the prices shown are only a guide.  All orders will be charged  in Australian Dollars as shown on your order confirmation. We can not be held responsible for any differences to the exchange rate between the time of purchase and the time the payment is completed.  

Whilst we try to ensure that all prices on our website are accurate, mistakes can sometimes occur. If we discover an error in the price of products you have ordered we will contact you as soon as possible and give you the option of either reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as being cancelled. If the order is cancelled, we will refund any money, which we have taken from you.

We reserve the right to change our prices.

3. Availability:
All orders are subject to availability of products. If products you order are not available we will notify you (where possible) and, if we have received the price and the delivery charges of the unavailable products, we will refund them to you or send you a list of order alternatives within 30 days of your order unless you agree to a longer period.

4. Delivery:
Our aim is to get your order delivered within 5-10 business days to all addresses. All products require a signature when delivered. If products are returned to us as undeliverable we shall attempt to contact you to arrange re-delivery. This will incur an additional postage charge. If we are unable to contact you we will refund the price of the products only. The original postage charge cannot be refunded due to administrative costs. Once the products are delivered they will become your risk and we will not be liable for any subsequent damage, loss or destruction to them. 

Please note that missing parcels cannot be used for a claim until at least 25 working days after the order is dispatched

Whilst we sympathise, we are unfortunately unable to offer any refund on missing parcels until the postal services have deemed the parcel to be lost. This can take a further 28 days from the date of claim. 

5. Returns Policy:

We have a no hassle - no worries return policy meaning that if the item you receive is not right, whatever the reason, contact us within 7 days of receiving your order, we'll give you details on how to return it and once we receive it back, we will promptly refund your money or you can exchange it for something else. But there's a few conditions you should be aware of:
- You the customer has to pay for postage costs (by which we are not responsible if it is lost in the means of getting to us).
- Everything must be returned in original, unused condition.
- Almost all items that have been worn outside (especially shoes) will show signs of wear and will no longer be in original condition, thus it is important to try everything on indoors or we cannot accept or process your return if this occurs.

If the manufactures recommended cleaning instructions are followed and the product has been used for its intended purpose, generally almost all faults will appear within the first 3 months after purchase. For this reason you may return any faulty item up to 3 months after the date of purchase. This product would then be professionally inspected for any faults of manufacture and a judgement made. If the damage to the product is deemed accidental damage/wear and tear, the product will be returned to the customer. If the inspection reveals any fault of manufacture then the product will be exchanged for new replacement product or fully refunded. If a product is deemed faulty, we will re-emburse you with reasonable costs of your return shipping charge if you include a receipt.

Nothing in this Returns Policy affects any statutory rights you may have as a consumer.

6. Samples:
Corporate Clients

Corporate clients may request samples from our product range. Samples are normally charged for, plus carriage and are Non-Returnable.

7. Product Liability:
No liability will be accepted for products where they have been engraved by a third party.

8. Validity:
If any of these Terms and Conditions are unenforceable it shall not affect the enforceability of the rest of these Terms and Conditions.

9. No Variation or Representation:
Nothing said by our sales personnel shall amount to a variation of these Terms and Conditions or a representation about the nature or quality of our products.

10. Third Party Rights:
We may transfer our rights under the contract, but otherwise nothing in these Terms and Conditions shall give any person who is not a party to the contract any benefit or any right to enforce any of the terms of the contract.

11. Governing Law and Jurisdiction:
Your order and the formation of the contract shall be governed by and interpreted in accordance with Australian law

The Australian Courts shall have jurisdiction to hear disputes between us.
